Garland Uber driver accused of sexually assaulting child shot, arrested at Houston McDonald's

Task force officers shot a child sex crime fugitive in Houston months after he cut off his ankle monitor and fled North Texas.

The fugitive was initially arrested last summer after being accused of raping a 12-year-old girl in Plano.

What we know:

A Be On the Lookout (BOLO) was issued on Jan. 16 for Robert Gregory Johnson III, 33, of Garland, who had been on the run since August when he removed his court-ordered ankle monitor. 

The U.S. Marshals Task Force in the Houston area followed a lead from the East Division in Plano that led them to a Houston McDonald's Tuesday morning.

"When our team made entry into the McDonald's, they had decided that it was deemed a safe environment. They attempted to give him verbal commands, at which time it didn't comply," explained U.S. Marshal Deputy Cameron Welch.

Officers used a Taser on Johnson, but they say he still didn’t comply.

Authorities say Johnson reached into a bag. Task force officers outside the McDonald's deemed it a threat and fired, hitting Johnson. Even then, they say he still didn’t comply. 

"It was at that time that a task force K9 was deployed, at which time he actually was subdued and taken into custody," said Welch.

While the extent of Johnson’s injuries is unknown, he is expected to survive.

No one else was injured.

Uber driver arrested for child sex assault

The backstory:

Johnson was arrested in Plano last July and charged with sexual assault of a child of a 12-year-old girl.

Investigators say Johnson was working for Uber Health on July 9 when he responded to a pickup request in Frisco and picked up an unaccompanied minor. 

Police say Johnson picked the girl up from a therapy facility in Frisco to take her home to Plano.

The conversation during the ride was very graphic, investigators say.

Johnson then pulled off the road onto Legacy Drive in Plano. That’s when police say he made the girl get in the front seat and sexually assaulted her in the parking lot.

Before he dropped her off, Johnson allegedly told the girl if she said anything, there would be "issues."

Police say the girl was alone in the Uber because her mom called for the ride on the Uber Health app designed to take people to and from medical facilities.

According to the arrest affidavit, the girl told her therapist the next day.

Johnson was arrested on July 12 and charged with aggravated sexual assault of a child.

Court documents show Johnson posted a $200,000 bond and was being tracked by an ankle monitor. 

What's next:

Once Johnson is medically cleared, he’ll be brought back to Collin County to face charges.

It’s unclear what additional charges Johnson will face related to Tuesday's incident.

The Texas Rangers are investigating the officer-involved shooting in Houston.
