Oak Lawn murder suspect says he shot victim in self-defense

The North Texas man on trial for capital murder for the shooting death of an insurance salesman last year took the stand Thursday, admitting he pulled the trigger.

Defendant Deric Madison testified it was self-defense when he shot 33-year-old Josh Tubbleville in May of 2014.

Madison testified that Tubbleville befriended him and a homeless man, inviting the two up to his Oak Lawn apartment for late night drinks and a brief game of dominoes.

The homeless man was asked to leave.

Madison testified that he and Tubbleville continued drinking until about 6 a.m., when the two got into Tubbleville's Mercedes and the insurance salesman accused Madison of taking his phone.

When Madison denied taking the phone, he claims Tubbleville pulled a gun.

Madison testified that Tubbleville crashed the car, let go of the gun and that Madison then took it and shot him.

Madison's testimony directly contradicts police testimony.

Prosecutors allege Madison's motive was theft, and that he'd changed his story more than 30 times from his first interview with police.

Madison faces life in prison or the death penalty.
