Escort testifies in case of man who shot boy in face

An escort testified on Friday that Brian Cloninger was on a beer drinking binge at her apartment before Cloninger shot a little boy.

Cloninger pleaded no contest to injury to a child charges for shooting 8-year-old D.J. Maiden, Jr. in the face in September 2013.

The escort's real name is Ivan Baltimore, but she goes by Roxy. She was the last person to have contact with Cloninger before the shooting.

Roxy told the court that Cloninger made a date with her, came to her apartment at the La Bella apartments where the shooting happened, and began quickly consuming beers.

She said she told him to go, and he wouldn't at first, becoming physical with her.

She picked up her cell phone and started recording him.

In the recording Clonginger can be heard saying, "Aw, come on."

Roxy can then be heard saying, "I'm gonna show you how drunk you are because, this is like not cute that you're this drunk and we talked about this on the phone."

Roxy says she called Cloninger's home number, leaving a message for his wife. Roxy says obtained the phone number during one of Cloninger's calls to her.

"I said, ‘Hi Marti, this is Roxy,'" said Roxy. "‘I'm an African-American transsexual. Your husband came here to see me and now he's in my apartment attacking me."

When she later learned about the shooting, she testified she felt like he was involved.

"When I found out that it was not him getting shot and that it was actually him did the shooting then again, then again, I just was like, ‘OK, well I guess I can just wait for my phone to ring,'" said Roxy.

She was certain she would be contacted because she was the last person Cloninger had called.

Cloninger's attorney tried to suggest that Roxy was in part responsible, because she let him leave her apartment in a drunken state. The attorney also accused Roxy of drugging Cloninger.

"When did you have a chance to put something in his drink?" said the attorney.

"I said that I put something in his drink?" said Roxy. "I don't recall saying that, ever."

"When did you?" said the attorney.

"I never did," said Roxy.

Defense attorneys also hammered away at the lead detective on the case for all the things the investigation did not include.

The defense presents in earnest starting Monday morning.
