Affidavit: Dallas Pre-K teacher investigated for third sex assault

FOX 4 News has learned the Dallas ISD Pre-K teacher arrested for the sexual assault of two children nearly a decade ago is also being investigated for assaulting a possible third victim in Plano.

Jorge Ruiz, 53, remains in the Dallas County Jail after he was arrested Wednesday morning. He was a teacher at Arthur Kramer Elementary School in North Dallas.

This arrest warrant affidavit is filled with graphic and disturbing content. The now 16-year-old girl says when she was 7 and was afraid to tell her mom what happened but has now moved past the incident. And according to the court document, she told her therapist about the alleged assault.

Jesse Gonzalez is very familiar with this kind of case. In the last 12 years at the Dallas Children's Advocacy Center, she's interviewed nearly 5,000 girls and boys. She says it’s not unusual for sexual assault victims, especially children, to wait sometimes years before coming forward.

"One of the things that's important for us is can that child describe these events and kind of give accounts of everything that's happened to them from beginning to end,” she explained.

Court records say Ruiz sexually assaulted one little girl multiple times between Sept. 2006 and June 2007 and did it at least one time at the school while other students were playing at recess. The affidavit says he was the child's first-grade teacher.

Investigators also charged Ruiz with molesting another child during the same time period nearly a decade ago.

Gonzalez says she can tell victims are telling the truth when they give specific sensory details.

Retired judge, turned defense attorney, John Creuzot doesn't represent anyone in this case but discussed the challenges of prosecuting cases like this one.

"Why would somebody, a child or an adult, either way, wait ten years to expose what they allege happened to them?” he questioned. “And so that immediately, most jurors have a question about that."

"When it's a delayed disclosure, obviously some of the details are going to kind of fade, right? But the ‘who’ and the ‘what’ is not,” Gonzalez said. “They are going to be able to tell me the person that did harm to them and what is they did."

The Ruiz arrest affidavit mentions another child, a possible third victim in Plano who has also made sex abuse allegations. Plano police confirmed they are investigating. 

"It makes it more difficult to defend when you have other complaining witnesses coming forward,” Creuzot said.

Ruiz declined a request for an interview, and calls to his attorney have not been returned. Dallas police say they have nothing new to add.
